Guidance for Members of the Public Served by An Exempted Drinking Water Supply

An Exempted Supply is defined as a supply of water which -
(a) (i) constitutes an individual supply of less than 10m cubic metres per day on average or serves fewer than 50 persons, and
(ii) is not supplied as part of a public or commercial activity, or
(b) Is used exclusively for the purposes in respect of which the relevant Supervisory Authority (in this case Monaghan County Council) is satisfied that the quality of the water has no influence, either directly or indirectly, on the health of the consumers concerned.
The two main types of water supply that fall into this category of exempted supplies are;
(i) private wells serving domestic dwellings and
(ii) small Group water Schemes (generally serving less than 50 persons).
Under Regulation 14 of the Drinking Water (No. 2) Regulations 2007 (S.I. No. 278 of 2007), Monaghan County Council as the Supervisory Authority, is obliged to:
(1) Notify the population served by an exempted supply of:
(a) the fact that these Drinking Water Regulations do not apply to such a supply and;
(b) action that can be taken to protect human health fromm the adverse effects resulting from any contamination of water intended for human consumption, and
(2) Where it is apparent to Monaghan County Council that a potential danger to human health arises from the quality of an exempted supply, it shall in accordance with guidelines issued by the Environmental protection Agency (EPA), ensure that consumers are given appropriate advice promptly.
(3) The EPA may issue guidelines for the purposes of the above which shall be binding.
